General Terms and Conditions for the Use of the Webshop of Racing Unleashed Cham AG

1. Scope

1.1. The General Terms and Conditions (hereinafter referred to as "Terms and Conditions") apply to all legal transactions and the associated purchases of vouchers and products that can be obtained in the webshop of Racing Unleashed Cham AG.

1.2. Racing Unleashed Cham AG reserves the right to change these T&Cs at any time. The version of these Terms and Conditions valid at the time of the order is decisive, which cannot be unilaterally changed for this order. Conflicting or deviating terms and conditions of the customer will not be recognised.

1.3. The offer of products in the online shop is aimed exclusively at customers with residence or company headquarters in Switzerland or Liechtenstein.

1.4. Deliveries are made exclusively to addresses in Switzerland or Liechtenstein.

1.5. The offer is valid as long as the product can be found via the search engine in the online shop and/or stocks last.

1.6. For all product orders with a minimum age of 12 years or a height of 120 cm (in particular for vouchers for rides in our simulators), the customer confirms compliance with these regulations with the order.

1.7. Orders in non-household quantities can be rejected without justification.

2. Products and prices

2.1. Images of products in advertising, online shops, etc. are for illustrative purposes and are non-binding.

2.2. All sales prices published in the online shop represent final prices, which include all taxes (in particular VAT) and costs for packaging/s. Racing Unleashed Cham AG reserves the right to change the prices of the products and vouchers offered at any time. The price in the online shop at the time of the order is decisive for the conclusion of the purchase contract.

3. Availability and delivery time

3.1. Racing Unleashed Cham AG attaches great importance to providing up-to-date and accurate availability and delivery times in the online shop. However, delivery delays may occur, especially due to production or supply bottlenecks. All information on availability and delivery time is therefore subject to change at any time.

4. Conclusion

4.1. The products and prices in the online shop are considered an offer. However, this offer is always subject to the condition of an impossibility of delivery or an incorrect price indication, which terminates the contract.

4.2. The contract is concluded for products as soon as the customer places their order and the associated payment in the online shop.

4.3. Receipt of the automatically generated order confirmation does not imply a commitment that the product can actually be delivered. It merely indicates to the customer that the order placed has arrived at the online shop and that the contract with Racing Unleashed Cham AG has thus been concluded under the condition of delivery and the correct price indication.

4.4. Ownership of the ordered product takes place with the complete completion of the order.

5. Performances

5.1. Racing Unleashed Cham AG undertakes to provide the services ordered by the contractual partner (customer) and promised by Racing Unleashed Cham AG.

5.2. The contractual partner undertakes to pay the agreed prices for these and other services used.

5.3. The services include the products offered in the webshop.

6. Obligation to check

6.1. Customers must immediately check delivered products for accuracy, completeness and delivery damage.

6.2. Delivery damage, incorrect and incomplete deliveries must be reported within 5 calendar days from the time of delivery. The customer is aware that such a notification must be made via the contact form in the online shop. The customer must keep it in its original packaging as received and follow the instructions of the return process.

7. Liability & Warranty

7.1. If, at the time of conclusion of the contract, no deviating conditions or a clearly different product description of the seller applies and the parties have not agreed otherwise, the following content of the contract shall apply to sales contracts:

a) The content of the purchase contract between the Seller and the Buyer is determined by the product description listed by the Seller and the conditions visible on the online shop (esp. selling price).

b) The product description is part of the contract, i.e. the seller assures that the product has the described characteristics.

c) The Seller is liable for material defects within the scope of the warranty, i.e. for defects not described, which cancel or significantly reduce the value or use of the item for the intended use during only 5 working days after receipt of the goods. In the event of material defects, the product must be returned in its original packaging and will be replaced to the buyer free of charge after inspection.

d) Racing Unleashed Cham AG can optionally provide the warranty through the following services:

i. Partial or total replacement with an equivalent product.

ii. Credit note at the daily price.

e) All further and, in particular, the statutory provisions on warranty are excluded.

f) All disputes between seller and buyer in connection with the purchase contract are subject to substantive Swiss law, to the exclusion of the Vienna Convention on Contracts for the International Sale of Goods.

8. Payment

8.1. Racing Unleashed Cham AG asserts all payment claims for products purchased via the Racing Unleashed Cham AG online shop directly from the customer.

8.2. Payments must be made in Swiss francs.

9. Change of order or cancellation

9.1. Orders oblige customers to accept the products. Racing Unleashed Cham AG can accept subsequent changes or cancellations of customer orders at its own discretion and charge a compensation of 10% of the cancelled order value, but at least CHF 20, as well as any loss in value of the cancelled products since they were ordered.

9.2. Vouchers are generally excluded after receipt of cancellations or returns.

9.3. The shipping costs for the return are generally at the expense of the sender. If the return is registered correctly, the return costs will be covered in the following cases:

a) For incorrectly delivered item

b) Upon receipt of an item that has not been ordered

c) Upon receipt of a defective item

d) If you receive an incomplete product

9.4. If, after placing an order or concluding a contract in accordance with Section 4, a (partial) delivery impossibility (resolutive condition) occurs, the customer will be informed by e-mail. If the customer has already paid, this amount will be refunded to them. Further claims due to delay in delivery or failure of delivery are excluded.

10. Resignation of Racing Unleashed Cham AG

10.1. Racing Unleashed Cham AG is also entitled to withdraw for good cause in accordance with the statutory provisions or in the event of a violation of one or more provisions of these GTC and/or the contract between Racing Unleashed Cham AG and the contractual partner by the contractual partner, in particular if:

a) Force majeure or other circumstances for which Racing Unleashed Cham AG is not responsible make the performance of the contract impossible.

b) Orders are carried out with misleading or false statements of material facts. In the event of justified withdrawal by Racing Unleashed Cham AG, the contractual partner shall not be entitled to damages.

11. Other provisions

11.1. Returns that cannot be assigned to any customers or cannot be returned to customers will be kept by Racing Unleashed Cham AG for six months and then disposed of.

11.2. The data protection declaration applies to the processing of personal data by Racing Unleashed Cham AG.

11.3. Vouchers are valid for five years after issue.

12.    Final provisions

12.1. The place of jurisdiction is CH-6300 Zug.

12.2. Swiss law applies.

12.3. Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions apply
